Terms & Conditions

Privacy, security and confidentiality are important to Myrtle & Mace. The following terms and conditions endeavour to make our web site a safe place to trade. You should understand that by using this web site you agree to the following terms and conditions.

General

Your contract is with Amanda Delaney T/A Myrtle & Mace of 14 Staveley Mill Yard, Staveley, Kendal, Cumbria, United Kingdom. LA8 9LR.
A contract will ONLY exist between you and Myrtle & Mace for the purchase of any product(s) when and until Myrtle & Mace accepts your order. This acceptance will be in the form of an e-mail confirming the details of your order and a second email notifying you that your order has been despatched.
Only once Myrtle & Mace has sent you the e-mail shall the acceptance be deemed complete (whether or not you receive the e-mail). Any such contract will be deemed to have concluded in the United Kingdom and will be enforced and interpreted in all respects in accordance with the Laws of England.
Orders are accepted at the sole discretion of Myrtle & Mace but are normally accepted if the products ordered are available, the order description and pricing are accurate, we are able to deliver to the delivery address and your credit or debit card is authorized for the transaction.
If we discover an error relating to your order, we will contact you as soon as possible to advise you of the error and confirm that you still wish to proceed.
A statutory cooling off period of 7 days applies to all orders in accordance with ‘The Consumer Protection (distance Selling) Regulations 2000’.

Payment
Myrtle & Mace do not store any credit card information. We use Paypal for online credit and debit clearing, for further information about Paypal visit their website at www.paypal.com.
You undertake that all details which you provide to us for the purpose of ordering goods are correct, you are aged 18 or over, that the credit or debit card you are using is your own, and that there are sufficient funds to cover the cost of the order.

Delivery
Standard delivery charge for seeds is £1.95, other small items are £4.95 to UK mainland addresses excluding the Scottish Highlands. Items in stock should arrive within 10 working days. Addresses in the Scottish Highlands and non mainland UK please contact for delivery costs. Items will be delivered by Royal Mail or courier. Please let us know if you have any special instructions for your order.
Furniture delivery charge is £14.95.

Express delivery. If you require item(s) more quickly than our standard delivery, we can offer an express service subject to the goods being in stock. Please contact us for a quote.

Overseas delivery charge If you would like to place an order for overseas delivery, please contact us at info@myrtleandmace.com or telephone us on +44 1539 822022 and we will give you details of the delivery charge.

Duties

If your delivery address is outside the United Kingdom, you may be subject to import duties and/or taxes. You understand that any and all charges of this nature will be borne by you.

Damaged Goods

On occasion goods are damaged during transit. Before you sign for the goods, please inspect them to ensure that they have arrived undamaged, otherwise you may have certified to the courier company that you have received the delivery in good order and we will not be able to rectify any damages. If you aren't in when the goods are signed for, you must contact us within 24 hours of the delivery taking place to notify us of any damage or shortages.

Returns & Exchanges

We try at all times to please our customers. If you are not happy with a product, notify us within 14 days at info@myrtleandmace.com or by telephone on +44 1539 822022 and return the goods to; 14 Staveley Mill Yard, Staveley, Kendal, Cumbria, UK. LA8 9LR.
Post and Packaging costs are not refundable. Items will be refunded or exchanged provided that you do not use the items, the items are in the same condition as when they arrived, and you take reasonable care to ensure the items are received by us and not damaged in transit. You are responsible for the cost of return Postage and packaging. We are not responsible for return postage or packages that do not reach us. To prevent this please use an insured, signed courier or ask at the Post office for a free certificate of postage.
Delivery and return costs will be refunded only if the goods are faulty or damaged in transit.

Product Descriptions

Every care has been taken to ensure that the descriptions and specifications were correct at the time of going to press.
All dimensions are approximate and while we make every effort to reproduce colour accurately there may be slight colour variations that occur due to monitor and printer settings. Some of the products are natural and handmade and may vary slightly from the picture.

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect your personal information in order to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. You will be given the chance to refuse any marketing email from us in the future.

We will not pass your details onto any third parties except in order to deliver your order.

Liability

Myrtle & Mace attempts to ensure that the information available on the website at any one time is true and accurate but cannot guarantee that it will be error-free. We do not accept liability for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.
Mytle & Mace does not accept liability for any indirect or consequential loss arising out of the use of the website or for any products or services purchased from the website. We make no representations about the fitness for a particular purpose of any of the products or services available on this website.
We make no guarantee that the website is free from infection by viruses or other destructive programmes. Our website contains links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.
These terms are governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
